Special Care: Substance Abuse, Mental Health and Development Disabilities

We represent special care providers offering substance abuse rehabilitation, mental health counseling and services for the developmentally disabled and mentally challenged.

We serve as counsel for clients before state agencies having jurisdiction over such services: the New York State Office of Alcoholism and Substance Abuse Services (OASAS), the New York State Office of Mental Health (OMH), and the New York State Office of Mental Retardation and Developmental Disabilities (OMRDD).

Our work on litigated matters in the mental health area includes:

  • Guardianships

  • Assisted outpatient treatment (“Kendra's Law”)

  • Retention hearings

  • Medication-over-objection hearings

  • Involuntary commitment

  • Requests for documents under “Jonathan's Law”

  • Subpoenas seeking privileged and statutorily protected information

Justice Center Investigations

We work with clients on the process for reporting and responding to The New York State Justice Center for the Protection of People with Special Needs.

We advise providers on best practices, obligations and the impact investigations can have on employees, licensure and operations.
