Marc practices primarily health care, litigation, and business and commercial transactions.  In the health care field, he has counseled a wide variety of clients, including health care delivery systems, hospitals, diagnostic and treatment centers, nursing homes, drug and alcohol treatment centers, hospices, physician practices, professional corporations and companies, and individuals with respect to the full range of issues, such as risk management, mergers under the not-for-profit corporation law, negotiation of contracts, confidentiality of medical records, advance directives, tax exemption, and real estate matters.  He also represents not-for-profit organizations and closely held businesses outside the health care field.

Marc has substantial experience with health care corporate, regulatory, and anti-fraud and abuse compliance.  His representational matters include internal and external investigations involving the federal Anti-Kickback Statute, “Stark” law (including disclosures under the Centers for Medicare & Medicaid Services (CMS) Self-Referral Disclosure Protocol), the Provider-Based Rule, 340B drug discount program, among others. In addition, he has counseled a variety of providers in connection with United States Department of Health & Human Services Office of Inspector General (OIG) subpoenas, CMS additional document requests (ADRs) and targeted provider specific prepayment reviews, and New York State Office of Medicaid Inspector General (OMIG) audits.

Marc has also been engaged in a broad range of complex commercial litigation matters for various clients, including many nationally known corporations.  His litigated disputes involve such areas of the law as environmental contamination, toxic torts, highway design, directors and officer’s liability, catastrophic events, management of self-insured trusts, tax assessment and exemptions, and insurance coverage and procurement disputes, as well as business transactions and governmental enforcement activity.

Prior to entering private practice, Marc served as a confidential law clerk for the Rhode Island Superior Court.  He also worked as a Communications Coordinator for a member of the New York State Senate before attending law school.
